Acquisition of Lands by Foreigners in Brazil

 

  • The acquisition by sovereign funds comprised by resources from foreign states and foreign companies which hold more than 10% (ten percent), directly or indirectly, of any Brazilian company will also be subject to the approval of the National Defense Council and must maintain a legal reserve equal to more than 80% of its territory;

 

  • Any type of possession under indefinite term is prohibited, as well as partial or total lease or sublease, for an indefinite term, of rural property by a foreign individual or legal entity

 

  • Rural properties acquired or by any means owned by a foreign individual or legal entity shall comply with the provisions of art. 186 of the Federal Constitution, which details the social purpose of the property;

 

  • The acquisition by foreigners of properties located in areas that are essential to Brazilian national security depends on prior consent from the National Defense Council.
